FUNDISMART TERMS OF SERVICE: Effective Date: 01 January 2026 Last Updated: 15 February 2026 Company: FundiSmart Company Limited. Country: Tanzania. These Terms govern your use of: FundiSmart App (Customer App) FundiSmart Pro (Artisan App) FundiSmart Support (WhatsApp Business Automation/Bot) FundiSmart website and forums. By using FundiSmart, you agree to these Terms. 1. About FundiSmart FundiSmart is a digital platform that connects customers with independent artisans/technicians and provides tools such as: Profiles and portfolios Job requests and matching Messaging Ratings and reviews Community forums Automated Support & Notifications via WhatsApp Professional support tools FundiSmart is only a platform facilitator. FundiSmart: Is not an employer of artisans. Is not a contracting party to service agreements. Does not supervise or guarantee services All service agreements are directly between customer and artisan. 2. Eligibility To use FundiSmart: You must be at least 18 years old, or have guardian permission where allowed by law. You must provide accurate registration details. You must comply with Tanzanian laws. 3. Accounts You agree to: Keep login credentials secure Use only one account Not impersonate others Notify us if unauthorized access occurs FundiSmart may suspend accounts for violations. 4. How the Marketplace Works 4.1 For Customers Customers may: Search artisans Request services/jobs Communicate with artisans Leave reviews Customers agree to: Provide accurate job details Agree directly with artisans on price, scope, and timing Pay as agreed. 4.2 For Artisans Artisans may: Create professional profiles Upload portfolio content Receive requests and job alerts Communicate with customers Receive ratings Artisans agree to: Provide lawful and professional services Provide truthful information Respect customers and property Comply with Tanzanian laws. 5. Service Agreements & Liability When a customer and artisan agree on a job: The agreement is directly between them FundiSmart is not responsible for service quality, safety, timing, or pricing FundiSmart does not mediate disputes at this stage Users must agree independently on: Price Scope of work Timing Materials Payment method FundiSmart may introduce dispute tools in the future. 6. Payments Currently: FundiSmart does not process in-app payments Payments occur directly between users If payment features are introduced later, these Terms will be updated. FundiSmart may charge fees for: Subscriptions Premium features Promotional tools Partner services All fees will be disclosed before payment. Users remain responsible for taxes under Tanzanian law. 7. Ratings & Reviews Users may leave honest reviews. FundiSmart may remove reviews that are: Abusive Fraudulent Discriminatory Irrelevant Manipulating ratings is prohibited. 8. User Content You keep ownership of content you upload. You grant FundiSmart a license to: Display profiles Show portfolio images Operate forum features Promote platform services You may not upload: Illegal content Harassment or hate speech Explicit or harmful content Private data of others Malware or spam. 9. FUNDISMART FORUM RULES FundiSmart operates two forums: 9.1 FundiSmart Community Forum (Customers + Artisans) Purpose: Technical discussions Service-related questions Knowledge sharing Customer insights Industry conversations Only artisan/service-related topics are allowed. 9.2 FundiSmart Support Forum (Artisans + Verified Experts only) Purpose: Technical assistance Troubleshooting Professional guidance Skill development Business advice for artisans Only professional support topics allowed. 9.3 Forum Rules (Apply to Both Forums) Users must: Post only relevant technical content Communicate respectfully Avoid spam or promotions Avoid illegal or dangerous advice Protect privacy (no posting personal data) Provide clear and accurate information Moderators may: Edit or remove posts Warn or suspend users Restrict forum access FundiSmart is not liable for advice shared by users. 10. WhatsApp Support & Automation ​FundiSmart provides automated assistance and notifications through the WhatsApp Business Platform. ​By interacting with our WhatsApp Bot, you agree to receive service-related messages, job alerts, and support responses. ​Users must comply with WhatsApp's Acceptable Use Policy when interacting with our Bot. ​FundiSmart is not liable for data charges or service interruptions caused by third-party telecommunication providers or Meta Platforms, Inc. 11. Acceptable Use You may not: Commit fraud Harass users Misuse platform data Reverse engineer the app Copy branding without permission Engage in illegal activity 12. Verification Verification badges or certifications: Improve trust signals Do not guarantee service outcomes Users must exercise caution. 13. Disputes between Users Disputes between customers and artisans: Must be handled directly between them FundiSmart is not obligated to resolve them FundiSmart is not liable for resulting losses Future dispute tools may be introduced. 14. Suspension or Termination We may suspend accounts for: Violations of Terms Fraud or abuse Safety risks Repeated complaints Users may delete accounts anytime. 15. Service Availability We may: Update features Fix bugs Suspend services for maintenance Discontinue features We do not guarantee uninterrupted service. We do not guarantee the 100% uptime of third-party communication channels, including the WhatsApp Business API. 16. Disclaimer Services are provided “as is.” FundiSmart does not guarantee: Service outcomes Uninterrupted operation Error-free performance. 17. Limitation of Liability FundiSmart is not liable for: Service disputes Property damage or injury Lost profits or data User conduct If liability applies, it is limited to fees paid to FundiSmart in the last 3 months. 18. Indemnity You agree to hold FundiSmart harmless from claims arising from: Your services Your interactions Your content Your legal violations. 19. Intellectual Property FundiSmart platform, branding, and software belong to FundiSmart Company Limited. Unauthorized use is prohibited. 20. Governing Law. These Terms are governed by the laws of the United Republic of Tanzania. Disputes will be handled in Tanzanian courts. 21.
